Welcome to JosepHomes. These Terms of Service ("Terms") govern your access to and use of our website at josephome.com and your purchases from our store (together, the "Store"). By browsing or buying from the Store, you agree to these Terms. If you do not agree, please do not use the Store.

1. Who we are

The Store is operated by JosepHomes. For any questions, contact us through our contact page.

2. Eligibility

To place an order, you must be able to form a binding contract and be of the age of majority in your province or territory of residence. You are responsible for the accuracy of the information you provide, including your shipping and contact details.

3. Pricing and currency

All prices are shown in Canadian dollars (CAD). Prices and product availability may change at any time without notice. Applicable taxes, shipping charges, and any duties are calculated or explained at checkout (see Section 6).

4. Orders, acceptance, and cancellation

When you place an order, you are making an offer to buy. Your order is accepted only when we send you an order confirmation or ship your items. We may decline or cancel an order, in whole or in part, for reasons including stock availability, fulfillment feasibility, suspected fraud, or an error in pricing or product information, even after a confirmation has been sent. If we cancel an order you have paid for, we will refund you in full for the cancelled items.

If you need to cancel an order, please contact us through our contact page as soon as possible. Once an order has been fulfilled or shipped, cancellation may not be possible; in that case, our return process applies (see Section 8).

5. Product availability and fulfillment

Our products are sourced from suppliers in North America, and orders are fulfilled and shipped from North America. We make reasonable efforts to display products, colours, and details accurately, but we do not warrant that descriptions, images, or availability are error-free, and slight variations may occur. Availability is not guaranteed until your order is accepted.

6. Shipping, delivery, taxes, and duties

We ship to addresses in Canada. Orders are sent with tracked delivery, and typical delivery takes 5 to 10 business days after dispatch; timelines are estimates and not guaranteed. Shipping options, taxes, and any applicable duties are shown or explained at checkout. Title and risk of loss pass to you on delivery to the carrier. Full details are in our Shipping Policy.

7. Payment

You agree to provide a valid payment method. Payments are processed securely by Shopify and our payment providers. We do not store your full card details.

8. Returns and refunds

We accept returns within 30 days of delivery, provided the item is in its original condition and packaging. You are responsible for return shipping costs unless the item arrives damaged or defective. Damaged or defective items must be reported within 7 days of delivery, with photos. We will provide a return address after a return request has been approved. 9. Accounts

If you create an account, you are responsible for keeping your login credentials confidential and for activity that occurs under your account. Please notify us promptly of any unauthorized use.

10. Acceptable use

You agree not to use the Store to:

• break any law or infringe anyone's rights;
• misrepresent your identity or provide false information;
• attempt to gain unauthorized access to the Store or interfere with its operation or security; or
• introduce malware, scrape content without permission, or use the Store in a way that disrupts other users.

11. Intellectual property

All content on the Store, including text, product descriptions, images, graphics, logos, and the JosepHomes name and branding, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission, except as needed to browse and place an order for personal use.

12. Third-party links

The Store may link to third-party websites or services that we do not control. We are not responsible for their content, products, or privacy practices, and including a link does not imply our endorsement.

13. Disclaimers

The Store and its content are provided "as is" and "as available." To the maximum extent permitted by law, we make no warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Store will be uninterrupted, error-free, or secure. Nothing in these Terms limits any rights or warranties you have under applicable Canadian consumer protection law that cannot be excluded.

14. Limitation of liability

To the maximum extent permitted by law, JosepHomes will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Store or your purchase of products. Our total liability for any claim arising under these Terms is limited to the amount you paid for the order giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

15. Indemnity

You agree to indemnify and hold harmless JosepHomes and its operators from any claims, losses, or expenses arising out of your breach of these Terms or your misuse of the Store, to the extent permitted by law.

16. Changes to these Terms

We may update these Terms from time to time. The updated version takes effect when posted, and the "Last updated" date will reflect the change. Your continued use of the Store after changes are posted means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of Canada and the laws of the province or territory applicable to consumer purchases shipped to Canadian addresses, without regard to conflict-of-laws rules. Any dispute will be subject to the courts of that jurisdiction, except where applicable consumer protection law gives you the right to bring a claim elsewhere.
